Cross-border recognition is a critical stage in international dispute resolution involving insolvency proceedings. England's adoption of the Model Law via the Cross-Border Insolvency Regulation in 2006 transformed the landscape domestically but traditional common law recognition remains alive and well, sitting alongside other statutory gateways to provide insolvency practitioners with a flexible toolkit to remedy wrongdoing in multi-jurisdictional insolvencies. Our event will offer comparative discussion of the processes in the BVI and England, with our experienced panel discussing how they have utilised recognition processes globally as part of their dispute resolution strategy.

Geopolitical tension, economic fragmentation and expanding regulatory regimes are reshaping the landscape of cross-border litigation.

Big ticket disputes that were once driven primarily by commercial considerations are increasingly influenced by political and societal dynamics, sanctions regimes and competing legal frameworks.

This panel brings together practitioners from England and the United States to examine how global uncertainty continues to transform international dispute resolution and how practitioners and systems are responding.

The discussion will explore the rise of strategic litigation and “lawfare”, including the use of court proceedings to advance (or attack) political or reputational objectives.

At this event the Hon. Justice Gerhard Wallbank (Ag) will be speaking on the BVI as an offshore jurisdiction, touching on the work of the Commercial Court, the role of the judge, and the position of the BVI in a wider context. This event offers practitioners an insight into a jurisdiction of considerable global importance.

Justice Wallbank is a Kings Counsel of the Eastern Caribbean Supreme Court. He recently retired as a full-time judge of the ECSC, having served as the longest serving Judge of the Commercial Court in the Virgin Islands. He is currently sitting on a short term basis.

This will be a hybrid event; remote attendance will be possible, and Justice Wallbank will be speaking by video-link.

Decentralised Autonomous Organisations (DAOs) claim to operate without central control, legal personality , or jurisdiction. But when tens or hundreds of millions of dollars disappear, someone, something, somewhere must be sued.

This panel examines how DAOs operate in practice, how they are characterised in litigation, who can be sued, where, on what causes of action, and how courts are responding. It will also look at whether they may constitute collective investment schemes under section 235 FSMA.

Are DAOs general partnerships? Foundations? Trust structures? Or simply unincorporated associations with a marketing problem? When will the law catch up?
