The Court of Appeal in the Republic of Trinidad & Tobago hands down judgment in the Namalco Litigation
The Court of Appeal of Trinidad & Tobago yesterday handed down judgment in the long running case of Namalco v. Estate Management and Business Development Company Ltd (EMBD) No. P129 of 2022.
The Court of Appeal upheld the trial judge’s finding of an unlawful means conspiracy between mega contractor Namalco and the ex-Chief Executive of the state-owned entity EMBD, improperly to inflate prices for the construction of roads and housing sites for displaced Caroni sugar plantation workers on the island of Trinidad. Supplementary Agreements were declared invalid, reducing EMBD’s liability for work done from TT$ 1.3bn to less than TT$200mn.
George Hayman KC (together with Jonathan Acton Davis KC and Christopher Reid of Atkin Chambers, and Colin Kangaloo SC) acted successfully for EMBD at the trial in 2019 and on this appeal, in what has been the longest running and highest value commercial dispute in the Trinidad & Tobago Courts.
