Ted Loveday obtains pro bono costs order in bankruptcy case
In July and August 2025 Ted Loveday advised and represented an individual who was facing a bankruptcy petition from HMRC and the potential loss of his house and livelihood.
Appearing before Insolvency and Companies Court Judge Barber, Ted persuaded the court not only to dismiss the bankruptcy proceedings, but also to order HMRC to pay the client's costs on the indemnity basis, on the basis that HMRC had committed serious and unexcused procedural errors.
As a result Ted's client recovered his costs in full. Ted also obtained payment of a significant sum to the Access to Justice Foundation by way of a pro bono costs order, also assessed on the indemnity basis, and which will now be applied towards charitable causes.
Ted acted on a pro bono basis through the Chancery Bar Association's Bankruptcy Representation Scheme, which was established by Faith Julian and provides free representation to clients who cannot afford it.
