Supreme Court judgment in Recovery Partners v Rukhadze [2025]

The Supreme Court’s judgment in Recovery Partners & anr. v Rukhadze & ors., handed down last week, considers what role, if any, principles of causation have to play when deciding the scope of an account of profits, particularly in relation to a breach of fiduciary duty involving the pursuit of a maturing corporate business opportunity by directors after they have left office. This is an important judgment for anyone advising directors or other fiduciaries who are considering resigning from a company and setting up a competing business.
