Darragh K. Connell, leading Eoin MacLachlan, successfully defend multi-million dollar Commercial Court claim
Judgment has been handed down in Al Othman Holding Company v Al Rajhi Holding WLL [2025] EWHC 3078 (Comm) in which the Claimant’s claim for sums allegedly due under a loan agreement was dismissed by Mrs Justice Dias following a contested Commercial Court trial.
The Claimant’s primary claim was found to be time barred on the basis that no acknowledgment of the debt had occurred so as to reset the limitation clock.
The Claimant’s alternative claim based upon an alleged variation of the loan agreement was dismissed on an objective interpretation of the relevant contemporaneous correspondence.
The judgment is notable for its consideration of the requirements for a valid acknowledgment pursuant to sections 29 and 30 of the Limitation Act 1980. Issues of actual and ostensible authority to execute the loan agreement were also addressed in the judgment.
