Brexit Article 50 Litigation Trial commences

Dominic Chambers QC and Benjamin John, instructed by David Greene, Senior Partner and Head of Group Action Litigation at Edwin Coe LLP, are representing one of the Claimants at the trial of the Brexit Article 50 litigation (R (oao Miller and Santos) v The Secretary of State for Exiting the EU) in the Divisional Court before the Lord Chief Justice, the Master of the Rolls and Lord Justice Sales.

In the case, which has been described as the most important constitutional law case in living memory, the Claimants seek to prevent the Government from triggering Article 50 of the Treaty of Lisbon without the prior authorisation of Parliament. The trial commenced on 13 October 2016 and arrangements have been made for a probable “leapfrog” appeal to the Supreme Court to follow.
