Brexit: Article 50 Litigation

Dominic Chambers QC and Benjamin John, instructed by David Greene, Senior Partner and Head of Group Action Litigation at Edwin Coe LLP, represented the Claimant at the first hearing of the Brexit Article 50 litigation (Santos v The Secretary of State for Exiting the EU) in the Divisional Court on 19 July.

In the case, which has been described as the most important constitutional law case in living memory, the Claimant seeks to prevent the Government from triggering Article 50 of the Treaty of Lisbon without the prior authorisation of Parliament. Sir Brian Leveson, President of the Queen’s Bench Division, and Mr Justice Cranston set directions for a trial of the action in October before a Divisional Court presided over by the Lord Chief Justice, with arrangements being made for a probable “leapfrog” appeal to the Supreme Court to follow.
