BVI Court of Appeal hands down judgment in an appeal against striking out of claims in Ieremeieva litigation
Hannah Ilett represented the Claimants in their appeal against the striking out of the majority of their claims against the First Defendant.
The Claimants were successful in the first limb of their appeal, reinstating their trustee de son tort claims. The Court of Appeal of the Eastern Caribbean Supreme Court accepted that this was a developing area of law which was not suitable for strike out. The Court of Appeal rejected their second, “ex tunc”, limb of appeal.
This judgment is the latest in long-running litigation in which the Claimants are represented by Michael Gibbon KC and Hannah Ilett, instructed by Mourant Ozannes BVI.
