Jason Mitchell

Jason joined Maitland in August 2023 following the successful completion of his pupillage under the supervision of Caley Wright, Thomas Fletcher, Richard Fowler, and Rowena Page.

Jason is developing a broad commercial chancery practice that is complemented by his extensive experience in South Africa prior to joining the UK Bar. He accepts instructions in all of Maitland’s core areas of practice, including Commercial Litigation & Arbitration, Civil Fraud, and Insolvency & Asset Recovery, and has a particular interest in disputes and litigation that raise contested issues of jurisdiction and private international law. Jason is a Member of the Chartered Institute of Arbitrators (CIArb).

Before joining Maitland, Jason practised in South Africa at the Johannesburg Bar. There, Jason’s practice focused on Commercial Litigation and Arbitration, as well as Administrative, Regulatory, and Constitutional Law. He has appeared in all courts of South Africa, as sole counsel and in teams. Jason still advises on most areas of South African Commercial, Private, and Public Law, and is able to appear in South African courts and in foreign arbitrations with links to South Africa.

Jason’s recent experience as a barrister in South Africa before joining Maitland included:

  • Representing several insured businesses in South Africa’s test case about Covid-19 and business interruption insurance.
  • Advising a Europe-based company on various aspects of South African law, including enforcement of asset-backed securities, following the collapse and restructuring of the Steinhoff Group.
  • Representing the Johannesburg Stock Exchange in litigation against issuers.
  • Representing an Isle of Man subsidiary of an international corporate group in tax- and administrative-law disputes against the South African Revenue Service.
  • Representing a Mauritian venture capital fund in litigation relating to the disposal of shares in a Nigerian company.
  • Defending, on jurisdictional grounds, a Mozambican company in an arbitration against a South African contracting partner.
  • Representing international and South African companies in judicial reviews and procurement disputes.
