Committal Applications in the Civil Fraud and Commercial Spheres

Committal applications for contempt of court have become one of the most important weapons in the commercial litigator’s armoury. In the last 3 years alone there have been well over 100 reported cases in the area and in late 2020 an entirely new CPR Part 81 was introduced governing the procedure for bringing committal applications.

Maitland Chambers held a webinar on Wednesday 5 May 2021 where Thomas Grant QC and Caley Wright discussed strategy, timing and recent developments in committal applications in fraud and commercial cases. The webinar covered:

  • Overview of the jurisdiction;
  • Strategic considerations to committal applications: valuable pressure tactic or oppressive and time wasting?
  • Timing of the application: when is it time to commit?
  • Proving contempt: evidential requirements and difficulties;
  • Procedural matters and the new CPR part 81.
