Professional Negligence & Regulation/Discipline
Maitland has a long history of expertise in professional negligence disputes extending across the full range of Maitland’s other practice areas.
These will often be claims against accountants and auditors, other financial professionals and intermediaries, lawyers, and property valuers and surveyors; but we have also handled claims involving such varied subjects as architecture and building design, art valuation, estate agency, commercial agency, IT consultancy, corporate and personal taxation, and pension fund valuation.
That breadth of expertise is matched by a depth of experience: from cases determined at Supreme Court level, through the most complex and highest value claims, and into many claims of more modest value or complexity but which may, nevertheless, be of real financial or reputational significance for claimants and professional defendants (and their insurers).
We are in no way tied to either claimants or defendants: all those with expertise have deployed it on both sides, given them a thorough insight into the complexities and practicalities of these claims.
We can also bring extensive civil fraud experience to bear in cases involving the misuse of client money, and a deep knowledge of company law in cases involving directors, the misuse of company assets, or complex financial arrangements. We can also bring partnership expertise to case.
Our expertise in the related areas of professional regulation and discipline covers not only advising on regulatory requirements, but also disciplinary cases before tribunals, and enforcement and intervention on behalf of regulators (including the Law Society, Solicitors’ Regulation Authority and Bar Standards Board).
