Maitland provides expertise across a broad range of intellectual property rights, including copyright, performers’ rights, passing off, trade marks, broadcasting rights, ‘format’ rights, breach of confidence and image rights.
We act extensively for both owners and users of intellectual property rights, including record companies, film and television producers, and music, book and newspaper publishers, authors and composers as well as industry bodies representing rightsholders. Our expertise in these areas is complemented by our understanding of company and partnership law and cross-border issues of jurisdiction and enforcement and by our familiarity with the protective measures available to rightsholders through the court. We provide particular experience in relation to the online exploitation of intellectual property rights, both from a licensing perspective and with regard to the injunctive and other remedies available to rightsholders arising out of domestic law and EU directives. Our barristers represent clients regularly in the High Court (including IPEC) and appellate courts as well as in specialist tribunals such as the Copyright Tribunal.
